NFX Digital Services LLC. ("NFXTrade") respects and protects the privacy of its customers ("Users") who use its services, taking a series of measures to protect it. Therefore, in order for there to be transparency about its information handling practices, or how they operate, it decided to create this Privacy Policy (“Policy”) so that the rights of its Users are protected and protected.

NFXTrade will collect personal data and information in order to identify its Users and provide a safe experience on the Platform, always protecting all information provided and respecting their privacy.

NFXTrade is the Controller and responsible for your personal data, therefore, it determines the means and purposes of data processing in relation to e-wallet and cryptocurrency transactions.

1.2 - NFXTrade understands that many of its Users reside in European Union countries, so it has appointed a Data Protection Officer (“DPO”) who will be responsible for resolving issues and look at issues related to this Policy. If you have any questions about this Policy or how to exercise your rights, it will be explained below how you can contact the DPO and support.

1.3 - NFXTrade reserves the right to modify this Privacy Policy at any time and, when required by law, and undertakes to notify its Users > about any changes to this Policy. 2.1 - NFXTrade collects personal information from Users so that it can offer its services. Such information is collected for the purposes of legal compliance or for specific purposes related to the development of business activities that consist of offering a secure platform for the transaction of digital assets.

2.2 - Personal information is data that can be used to directly or indirectly identify the User. This Policy covers all personal information that the User voluntarily submits and that can be obtained from NFXTrade partners.

2.3 - The User is free to provide or not the requested personal information, however, NFXTrade will not guarantee that it will be able to respond effectively or offer its services in its entirety, if it chooses not to share the requested information.

2.4.1 - Personally Identifiable Information: Full name, date of birth, age, nationality, gender, home address, email, phone number, photographs.

2.4.2 - Formal identification information: Tax identification number, passport number, driver's license and national identity details, proof of residency.

Some of NFXTrade's core services are subject to laws and regulations that require us to collect and use your personally identifiable information, formally identifiable information, financial information, transaction information, employment information, online identifiers and/or usage data in certain ways. For example, NFXTrade must identify and verify clients using its services to comply with anti-money laundering and terrorist financing laws in all jurisdictions. The consequences of not processing your personal information for such purposes is the termination of your account, as NFXTrade cannot perform the services in accordance with legal and regulatory requirements;

EEA Residents: For individuals residing in the European Economic Area (including the UK) or Switzerland (collectively "EEA Residents") as per Article 6 of the EU General Data Protection Regulation (GDPR) or any equivalent legislation ( collectively "EEA Data Protection Act"), NFXTrade processes this personal information to comply with its legal obligations.


3.1 - To apply the terms in the NFXTrade user agreement and other agreements

  1. NFXTrade deals with very sensitive information, such as your identification and financial data, so it is very important for its clients to actively monitor, investigate, prevent and mitigate any potentially prohibited or illegal activities, applying the your contracts with third parties, and/or breaches of your published user agreement or contract for other services. In addition, NFXTrade may need to charge fees based on the use of its services. There is the collection of information about the use of your account and monitoring of your interactions with the Platform. Any of your personal information collected on the Platform may be used for these purposes. The consequences of not processing your personal information for such purposes is the termination of your account, as NFXTrade will not be able to perform the services contracted in accordance with the Terms of Use.

3.2 - To provide NFXTrade services

  1. NFXTrade processes your personal information to provide you with access to the Platform. For example, if a User wishes to sell or buy Cryptocurrencies, he/she must register and provide identifying information as well as contact information.

3.3 - To provide service communications

  1. NFXTrade will send administrative or account-related information to keep you up to date on the Platform so that issues, relevant security updates, transaction-related information become known to User. Without such communication, the User may not be aware of important developments related to his/her account that may affect his/her use of the Platform.

3.4 - To provide customer service

  1. NFXTrade collects your personal information when you contact the support team to resolve questions, disputes, collect fees or troubleshoot problems. Without processing your personal information for such purposes, NFXTrade will not be able to respond to your requests and guarantee uninterrupted use of the services.

3.5 - To ensure quality control

  1. NFXTrade processes your personal information for quality control and staff training to ensure we continue to provide accurate information. If we do not process personal information for quality control purposes, you may experience problems with the Services, such as inaccurate transaction records or other interruptions. The basis for such processing is based on the need to fulfill contractual obligations to you;
  2. EEA Residents: For all of the above categories, excluding the first point, under the EEA Data Protection Act, NFXTrade processes this personal information on the basis of the contract with you.

3.6 - To ensure network and information security

  1. NFXTrade processes your personal information to improve security, monitor and verify access to identities or services, combat spam or other malware or security risks, and to comply with applicable security laws and regulations. NFXTrade cannot guarantee the security of the Platform without processing your personal information;
  2. EEA Residents: In accordance with the EEA Data Protection Act, NFXTrade processes this personal information to satisfy legal obligations.

3.7 - For research and development purposes

  1. NFXTrade processes your personal information to better understand how you use and interact with the Platform. In addition, information is used to customize, evaluate and improve NFXTrade services, the content and layout of the website and applications and to develop new services. 3.9 - To participate in marketing activity

Based on your communication preferences, NFXTrade may send you marketing communications to inform you of events; to deliver targeted marketing; and provide promotional offers based on your communication preferences. NFXTrade uses information about your use of the Platform and your contact information to provide marketing communications. You can opt out of receiving marketing communications at any time.
  2. EEA Residents: In accordance with the EEA Data Protection Act, NFXTrade processes this personal information to satisfy your consent.


4.1 - NFXTrade reserves the right to share your information with trading partners for the sole purpose of verifying its veracity and legal status as mentioned above. You hereby expressly authorize such sharing.

4.2 - All data, information and content about you can be considered active in the case of trades in which NFXTrade takes part. Therefore, we reserve the right to include your data among the company's assets if it is sold, acquired or merged with another. By means of this Policy you agree and are aware of this possibility.

4.3 - Also, NFXTrade reserves the right to provide your personal data and information, including your interactions, if legally required, in accordance with the legislation of your country of residence.

4.5 - NFXTrade may disclose data and information of any User if required to do so by law, such as in the case of investigative proceedings or legal requests, or by order of a competent authority, such as regulatory agencies, government bodies, without prior notice and authorization from User, as required by applicable law.


5.1 - All your data is confidential and only people with the proper authorizations, established by the Controller, will have access to them.

5.2 - Any use of your data will be in accordance with this Policy. NFXTrade will make every effort to ensure the security of systems and your data. Servers are located in different locations to ensure stability and security, and can only be accessed through previously authorized communication channels.

5.3 - All your data will always be stored encrypted. At any time, you can request a copy of your data stored in our systems, just by contacting us. NFXTrade will keep data and information only as long as they are necessary or relevant for the purposes described in this Policy, or in the case of periods predetermined by law, or until when these are necessary for the maintenance of the legitimate interests of NFXTrade.

Therefore, it undertakes to keep only personal information for the time necessary to fulfill the purposes for which it was collected, including for the purpose of complying with legal, accounting or reporting obligations, or for the resolution of disputes. Retention requirements may vary by jurisdiction.


7.1 - For Users residing in the EEA, NFXTrade is the controller of your personal information, determining the means and purposes of data processing in relation to transactions carried out on the Platform.

7.2 - The legal bases for processing under the General Data Protection Act (GDPR) are described in Sections 3 and 4. NFXTrade may process your personal information:

  1. to satisfy legal obligations;
  2. if it is necessary to fulfill obligations arising from any contracts that NFXTrade has entered into or take steps to close future contracts;
  3. for the legitimate interests of NFXTrade.

7.3 - NFXTrade will only be able to contact you via the phone or registered email with information about the contracted platform services or similar. The User who does not want his/her information to be used for this purpose, simply object to the initial or subsequent processing for direct marketing purposes, at any time and free of charge in the contact channels and Support.

7.4 - EEA Users have the following rights:

  1. Right to withdraw consent: You have the right to withdraw your consent to the processing of your personal information collected on the basis of your consent at any time. Your withdrawal will not affect the lawfulness of NFXTrade processing based on consent prior to your withdrawal.

    1. The User disputes the accuracy of the personal information processed. In this case, NFXTrade will restrict processing for the period necessary for accurate verification of personal information.
    2. Processing is illegal and the data must be deleted or its use restricted.
    3. Personal information is no longer needed.
    4. The User withdraws its consent.

It is also possible for the User to complain about the processing of their personal information to the Data Protection Authority, and the complaint can be made in the Member State of the European Union where they live or in the place where the alleged violation occurred.


8.1 - NFXTrade reserves the right to change this Policy as often as necessary, in order to provide its clients with more and more security and convenience. 8.2 - The jurisdiction of the District of Wilmington - Delaware - USA is elected as the only one competent to annul any disputes arising from this document, regardless of any other, however privileged it may be or will be.
