NFXTrade will collect personal data and information in order to identify its Users and provide a safe experience on the Platform, always protecting all information provided and respecting their privacy.
1.2 - NFXTrade understands that many of its Users reside in European Union countries, so it has appointed a Data Protection Officer (“DPO”) who will be responsible for resolving issues and look at issues related to this Policy. If you have any questions about this Policy or how to exercise your rights, it will be explained below how you can contact the DPO and support.
1.4 - NFXTrade does not knowingly solicit personal information from anyone under the age of 18. If NFXTrade suspects that a user submitting personal information is a minor, NFXTrade will cancel the User account and delete their information ASAP.
2.1 - NFXTrade collects personal information from Users so that it can offer its services. Such information is collected for the purposes of legal compliance or for specific purposes related to the development of business activities that consist of offering a secure platform for the transaction of digital assets.
2.2 - Personal information is data that can be used to directly or indirectly identify the User. This Policy covers all personal information that the User voluntarily submits and that can be obtained from NFXTrade partners.
2.3 - The User is free to provide or not the requested personal information, however, NFXTrade will not guarantee that it will be able to respond effectively or offer its services in its entirety, if it chooses not to share the requested information.
2.4 - NFXTrade collects the following types of information:
2.4.1 - Personally Identifiable Information: Full name, date of birth, age, nationality, gender, home address, email, phone number, photographs.
2.4.2 - Formal identification information: Tax identification number, passport number, driver's license and national identity details, proof of residency.

4.1 - NFXTrade reserves the right to share your information with trading partners for the sole purpose of verifying its veracity and legal status as mentioned above. You hereby expressly authorize such sharing.
4.2 - All data, information and content about you can be considered active in the case of trades in which NFXTrade takes part. Therefore, we reserve the right to include your data among the company's assets if it is sold, acquired or merged with another. By means of this Policy you agree and are aware of this possibility.
4.3 - Also, NFXTrade reserves the right to provide your personal data and information, including your interactions, if legally required, in accordance with the legislation of your country of residence.
4.4 - In all cases where information is shared, the company will be required to adhere to the same standards, as appropriate, of confidentiality, anonymization and storage of information as those adopted by NFXTrade.
4.5 - NFXTrade may disclose data and information of any User if required to do so by law, such as in the case of investigative proceedings or legal requests, or by order of a competent authority, such as regulatory agencies, government bodies, without prior notice and authorization from User, as required by applicable law.
5.1 - All your data is confidential and only people with the proper authorizations, established by the Controller, will have access to them.
5.2 - Any use of your data will be in accordance with this Policy. NFXTrade will make every effort to ensure the security of systems and your data. Servers are located in different locations to ensure stability and security, and can only be accessed through previously authorized communication channels.
5.3 - All your data will always be stored encrypted. At any time, you can request a copy of your data stored in our systems, just by contacting us. NFXTrade will keep data and information only as long as they are necessary or relevant for the purposes described in this Policy, or in the case of periods predetermined by law, or until when these are necessary for the maintenance of the legitimate interests of NFXTrade.
6.1 - The User has the right to review, correct or change his/her personal information or to delete such information when it is inaccurate, at any time. Therefore, Users have the following rights in relation to the use of their personal information:
6.1.1 - Rights of access, correction and deletion: You have the right to access the personal information we hold about you in accordance with European data protection legislation and certain related information. It may also require that any inaccurate personal information be corrected or deleted.
6.1.2 - Right to object: You may object to the use of your personal information for direct marketing purposes at any time and you may have the right to object to the processing of some or all of your personal information (and require it to be deleted) in other circumstances.
6.1.3 - If the User wishes to exercise any of these rights, just contact the NFXTrade team as described below.
6.2 - NFXTrade stores your personal information securely for the life of your account on the Platform. Therefore, it undertakes to keep only personal information for the time necessary to fulfill the purposes for which it was collected, including for the purpose of complying with legal, accounting or reporting obligations, or for the resolution of disputes. Retention requirements may vary by jurisdiction.
7.1 - For Users residing in the EEA, NFXTrade is the controller of your personal information, determining the means and purposes of data processing in relation to transactions carried out on the Platform.
7.2 - The legal bases for processing under the General Data Protection Act (GDPR) are described in Sections 3 and 4. NFXTrade may process your personal information:
7.3 - NFXTrade will only be able to contact you via the phone or registered email with information about the contracted platform services or similar. The User who does not want his/her information to be used for this purpose, simply object to the initial or subsequent processing for direct marketing purposes, at any time and free of charge in the contact channels and Support.
7.4 - EEA Users have the following rights:
7.5 - The rights of EEA residents can be exercised by contacting the Data Protection Officer at [email protected] so that NFXTrade can consider your request under the applicable law. NFXTrade may verify your identity before fulfilling your request in order to protect your privacy and security.
7.6 - NFXTrade will communicate any rectification or deletion of the personal information of its Users. The User may file a claim if he believes that NFXTrade has infringed his rights.
7.7 - The User may contact the Data Protection Officer via email [email protected]ade.com so that NFXTrade can resolve the issue or dispute internally. It is also possible for the User to complain about the processing of their personal information to the Data Protection Authority, and the complaint can be made in the Member State of the European Union where they live or in the place where the alleged violation occurred.
8.1 - NFXTrade reserves the right to change this Policy as often as necessary, in order to provide its clients with more and more security and convenience. That is why it is very important to access the Policy periodically. To make it easier, the date of the last update will always be indicated at the end of the document. Any changes to this Policy, which require new authorizations from Users, will be notified.
8.2 - The jurisdiction of the District of Wilmington - Delaware - USA is elected as the only one competent to annul any disputes arising from this document, regardless of any other, however privileged it may be or will be.
